{"id":1672,"date":"2017-09-22T16:49:59","date_gmt":"2017-09-22T14:49:59","guid":{"rendered":"https:\/\/www.lafoliedespapiers.com\/conseils\/?p=1672"},"modified":"2020-04-02T17:08:40","modified_gmt":"2020-04-02T15:08:40","slug":"negocier-accord-collectif-sans-delegue-syndical","status":"publish","type":"post","link":"https:\/\/www.lafoliedespapiers.com\/conseils\/negocier-accord-collectif-sans-delegue-syndical\/","title":{"rendered":"N\u00e9gocier un accord collectif sans d\u00e9l\u00e9gu\u00e9 syndical dans une TPE (- 11 salari\u00e9s)"},"content":{"rendered":"<p>Dans les <strong>entreprises d\u00e9pourvues de d\u00e9l\u00e9gu\u00e9 syndical<\/strong> et dont l&rsquo;effectif habituel est<strong> inf\u00e9rieur \u00e0 11 salari\u00e9s<\/strong>, l&#8217;employeur qui souhaite mettre en place un accord collectif dans l&rsquo;entreprise peut proposer aux salari\u00e9s un <strong>r\u00e9f\u00e9rendum<\/strong> <em>(<\/em><a href=\"https:\/\/www.legifrance.gouv.fr\/eli\/ordonnance\/2017\/9\/22\/MTRT1724786R\/jo\"><em>Ordonnance n\u00b0 2017-1385 du 22 septembre 2017 relative au renforcement de la n\u00e9gociation collective<\/em><\/a><em>)<\/em>.<\/p>\n<p>En effet, l&#8217;employeur peut proposer un projet d&rsquo;accord aux salari\u00e9s, qui porte sur l&rsquo;ensemble des th\u00e8mes ouverts \u00e0 la n\u00e9gociation collective d&rsquo;entreprise <em>(<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000036761872&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20180401\">Article L2232-21 Du Code du travail<\/a>)<\/em>.<\/p>\n<p>La <strong>consultation des salari\u00e9s<\/strong> est organis\u00e9e \u00e0 l&rsquo;issue d&rsquo;un d\u00e9lai minimum de 15 jours courant \u00e0 compter de la communication \u00e0 chaque salari\u00e9 du projet d&rsquo;accord.<\/p>\n<p>Les conditions dans lesquelles l&#8217;employeur recueille l&rsquo;<strong>approbation des salari\u00e9s<\/strong> sont les suivantes <em>(<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000036284063&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20171229\">Article R2232-10<\/a>)<\/em> :<\/p>\n<ol>\n<li>la <strong>consultation<\/strong> des salari\u00e9s doit \u00eatre r\u00e9alis\u00e9e par tout moyen et avoir lieu <strong>pendant le temps de travail<\/strong> ;<\/li>\n<li>l&#8217;employeur doit garantir le <strong>caract\u00e8re personnel et secret<\/strong> de la consultation :<\/li>\n<li>le r\u00e9sultat de la consultation est <strong>port\u00e9 \u00e0 la connaissance de l&#8217;employeur<\/strong> \u00e0 l&rsquo;issue de la consultation qui doit se d\u00e9rouler en son absence ;<\/li>\n<li>le r\u00e9sultat de la consultation doit faire l&rsquo;objet d&rsquo;un <strong>proc\u00e8s-verbal<\/strong> dont la publicit\u00e9 est assur\u00e9 dans l&rsquo;entreprise par tout moyen.<\/li>\n<\/ol>\n<p><strong>Pour que cet accord soit valide<\/strong>, ce projet d&rsquo;accord doit \u00eatre <strong>ratifi\u00e9 \u00e0 la majorit\u00e9 des 2\/3<\/strong> du personnel <em>(<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000036761866&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20180401\">Article L2232-22<\/a>)<\/em>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans les entreprises d\u00e9pourvues de d\u00e9l\u00e9gu\u00e9 syndical et dont l&rsquo;effectif habituel est inf\u00e9rieur \u00e0 11 salari\u00e9s, l&#8217;employeur qui souhaite mettre en place un accord collectif dans l&rsquo;entreprise peut proposer aux salari\u00e9s un r\u00e9f\u00e9rendum (Ordonnance n\u00b0 2017-1385 du 22 septembre 2017 relative au renforcement de la n\u00e9gociation collective).
